After the hearing held last January in Pampa, and as expected, Judge Emmert endorsed the findings and conclusion submitted by the state of Texas.
The case is now back before the Court of Criminal Appeals in Austin.
The defense has until June 20th, 2018 to submit its supplemental brief and the state will then have until July 20th 2018 to file its response. Subsequently, the court will decide whether to hear oral arguments on the interpretation of the DNA results.
The Court will then decide whether the results of the DNA testings, had they been available to the jurors of Hank’s trial, would have led to a different verdict. If the Court agrees with him, Hank will then be given the opportunity to file an actual claim of innocence.
