On July 25th, 2005, the Federal Magistrate ordered an evidentiary hearing on the issue of DNA discovery and others contained in Hank’s Writ of Habeas Corpus. The hearing was held on November 16, 17 and 18, 2005, at the Federal Courthouse in Amarillo (Transcripts Volume 1, Volume 2 & Volume 3) and both parties filed their post hearing briefs (Defense & State) by January 10, 2006 (see follow-up documents in the “legal” section, post-conviction appeals). The magistrate, Judge Averitte, issued his Findings, Conclusions & Recommendation Report on September 29, 2006. Hank’s attorneys filed their objections on November 17th, 2006. On February 22, 2007, Judge Robinson issued a one-page judgment denying Hank’s federal writ.
